Southaven, MS Noise from Specific Sources: Delivery Truck Noise (2026)

Two items in the City of Southaven's list of specific unlawful noises reach delivery trucks. Section 10-122(8) covers the creation of a loud and excessive noise in connection with loading or unloading any vehicle, or the opening and destruction of bales, boxes, crates and containers. Section 10-122(1) covers any noise made by the motor of any automobile, truck or tractor that is not reasonably required in the operation of the vehicle under the circumstances, including backfiring and motor racing. Section 10-122 declares that the enumeration is not exclusive, so noise outside the listed items can still be a violation.

The noise chapter prints no delivery-window hours and no decibel limit for commercial vehicles. The test is Section 10-121: any loud, unnecessary or unusual noise that disturbs the peace and quiet of any location within the incorporated limits of the City of Southaven. Its factors include proximity to residential sleeping facilities, the nature and zoning of the area, the time of day or night, duration, whether the noise is continuous, recurrent or intermittent, and whether it is produced by a commercial or noncommercial activity.

Waste hauling has its own line. Section 10-97 makes it unlawful for anyone authorized to engage in waste disposal or garbage and rubbish collection to operate vehicle-mounted loading or compaction equipment so as to violate the chapter's standards, without abridging the powers of the state over motor vehicle control. Section 10-122(11) separately bars hauling rails, pillars or columns of iron, steel or other material along streets so as to cause loud noises. The chief of police or his designee enforces the chapter under Section 10-141.
