Full Breakdown

Sec. if it causes a noise disturbance across a residential property line, and barred at any time if it otherwise violates the general standard in Sec. 02. That general standard weighs volume, how prolonged the noise is, the contrast with ambient noise, proximity to residences, and time of day, so a delivery truck idling and banging pallets next to homes late at night is squarely what the clause targets even without a decibel meter. Sec. 04(a) carves out equipment operated in the public interest or for emergency or safety purposes, expressly naming garbage trucks and public utility equipment as exempt, which matters for early trash pickup noise.

The exemption does not cover ordinary retail or restaurant deliveries. Violations are enforced under Sec. 05 as a public nuisance the city attorney can abate, prosecuted as a misdemeanor or cited administratively, with each hour of continuing loading noise a separate offense. Property owners, tenants, and managers share joint-and-several responsibility for repeat delivery noise at a business address once they have been notified in writing of the problem, under Sec. 05(b)(4).

Violations & Fines

First violation: $250 administrative fine. Second within twelve months: $500. Third and later violations within twelve months: $1,000, per Sec. 5-12.05(b). Each hour of continuing loading/unloading noise is a separate offense, and the city attorney may prosecute criminally instead.

Frequently Asked Questions

Can delivery trucks unload at a Salinas business overnight?
Sec. 5-12.03(d) bars loading and unloading of boxes, crates, containers, or building materials between 10:00 p.m. and 7:00 a.m. when it creates a noise disturbance across a residential property line, so overnight deliveries near homes are restricted.
Are trash trucks exempt from Salinas's loading noise rule?
Yes. Sec. 5-12.04(a) exempts equipment operated in the public interest or for emergency or safety purposes, and specifically lists garbage trucks and public utility equipment among the exempt equipment.
Who can be fined for repeated delivery noise at a Salinas store?
The business owner, tenant, lessee, manager, or agent can all be held jointly and severally responsible under Sec. 5-12.05(b)(4) once the city has notified them in writing of the recurring noise disturbance and it continues.
