In its place, the Airport maintains a voluntary nighttime curfew: between 10 P.M. and 7 A.M. local time, takeoffs and landings of 'noisy' aircraft are requested to be avoided, with exceptions for emergencies, weather-alternative use of the airport, and air traffic control delays. Because of federal preemption, Burbank's own noise code (Title 9, Chapter 3) does not and cannot impose binding limits on aircraft in flight or airport operations.
The airport curfew is voluntary (reported compliance over 99%) and carries no municipal penalty; binding aircraft-noise authority rests with the FAA under ANCA and 14 C.F.R. Part 161.
