Jackson, MS Noise Ordinances: Aircraft Noise (2026)

Federal law preempts local control of aircraft noise in flight, and Jackson's code reflects that directly in its exemptions list at § 54-90. Subsection (3) carves out 'any aircraft in flight subject to federal law regarding noise control' along with 'any helicopter in the act of landing or taking off at a helipad licensed by the city,' with the caveat that the helicopter exemption only holds 'so long as the helicopter is not landing or taking off in violation of any conditions or restrictions of the helipad's license.' Subsection (5) adds a second, broader carve-out for 'sounds which originate at airports and are directly related to flight operations,' covering ground operations tied to flights at any licensed airport or helipad in the city.

Because these are exemptions from the Table A property-line decibel test in § 54-89 rather than free-standing prohibitions, there is no separate aircraft-noise complaint process, fine schedule, or curfew in the Jackson Code; a resident near a flight path has no local ordinance claim for aircraft-in-flight noise, and any regulatory recourse runs through the FAA's own noise-control framework rather than the city. The one condition Jackson does enforce locally is the helipad's own operating license: a helicopter landing or taking off outside that license's conditions loses the exemption and could then be measured against Table A like any other noise source.
