Canton, OH Noise Ordinances: Amplified Music & Outdoor Sound (2026)

Adopted by Ordinance 269-2017, Section 509.04 regulates "noise-making, noise-amplifying or noise-producing instruments or devices" separately from the general loud-noise catalogue in Section 509.03. Subsection (b) declares their operation a nuisance when it disturbs the peace and good order of a neighborhood, naming radios, phonographs, tape players, compact disc players, and loudspeakers, and defining "neighborhood" to include the vicinity of any school, place of worship, court, or hospital while in use. Subsection (c) adds a flat ban, regardless of volume, on operating a loudspeaker, public address system, or mobile sound vehicle on a public right-of-way or public space for a commercial purpose.

Subsection (f) lets the Director of Public Safety or a designee grant a special variance on application, weighing the hardship to the applicant against the impact on neighbors' health, safety, and property, with the variance conditioned and time-limited. Subsection (g)(4) exempts categories such as unamplified crowd or sporting-event noise, common-carrier stations, public maintenance vehicles, permitted parades and festivals, construction activity, and emergency alerts. Enforcement escalates: a first violation is a minor misdemeanor, a second is a fourth-degree misdemeanor, and a third or later violation is a third-degree misdemeanor, though an officer may issue a written warning in lieu of a first citation, recorded by the Canton Police Department so no more than one warning issues per violator.
