In the City of Upland, Municipal Code Section 9.40.100(B) makes it unlawful to play any radio, TV, musical instrument, phonograph, stereo, jukebox or other amplifying device when it is audible 50 feet or more from the source, or audible inside any other residence or establishment. Advertising loudspeakers cast onto public streets are also barred under Section 9.40.100(H).
Upland regulates amplified sound primarily through Section 9.40.100(B) of the Municipal Code. It is unlawful to play, use, operate, or permit the use of any radio, television set, musical instrument, phonograph, stereophonic equipment, jukebox, or other machine or device for producing, reproducing or amplifying sound when the sound is audible at a distance of 50 feet or more from its source, or when it is audible within any other residence or establishment. The 50-foot 'plainly audible' test gives officers an objective trigger separate from the decibel framework, and the 'audible within any other residence' clause is especially relevant to apartments and attached homes. The code reinforces this with the time-based residential ambient limits in Section 9.40.040 (45 dB(A) at night, 55 dB(A) by day), so amplified music exceeding those levels at a property line is also a violation. Commercial advertising sound gets its own prohibition: Section 9.40.100(H) makes it unlawful to operate any radio set, instrument, loudspeaker, sound amplifier, or similar device producing sound cast upon the public streets for commercial advertising or to attract public attention to a building or structure. Permitted city-sanctioned events are exempt under Section 9.40.100(Q). As an incorporated city, Upland applies these rules rather than San Bernardino County's, which cover unincorporated areas only.
Amplified sound audible 50 feet from the source or inside another residence violates Section 9.40.100(B), and advertising loudspeakers on public streets violate Section 9.40.100(H); both are misdemeanors under Section 9.40.110 (up to $1,000, up to six months in jail, or both, each day a separate offense). Persistent amplified noise may also be abated as a public nuisance under Section 9.40.130.
