The City of Upland sets numeric base ambient noise levels in Municipal Code Section 9.40.040: 45 dB(A) residential (10 p.m.-7 a.m.), 55 dB(A) residential (7 a.m.-10 p.m.), 65 dB(A) for unspecified uses anytime, and 75 dB(A) for industrial/commercial anytime. Section 9.40.070 limits how long noise may exceed those levels each hour.
Upland's noise code is one of the more quantitative city codes, with measured decibel standards in Chapter 9.40. Section 9.40.040 establishes base ambient noise levels (BANL) by zone and time: 45 dB(A) for residential from 10 p.m. to 7 a.m.; 55 dB(A) for residential from 7 a.m. to 10 p.m.; 65 dB(A) anytime for uses not otherwise specified; and 75 dB(A) anytime for industrial and commercial. Actual measured levels that exceed these become the operative ambient level; otherwise ambient is treated as no lower than these floors. Section 9.40.070 then sets a sliding residential duration table: noise may reach the base ambient level for up to 30 minutes in any hour, 5 dB(A) above BANL for up to 15 minutes, 10 dB(A) above for up to 5 minutes, 15 dB(A) above for up to 1 minute, and 20 dB(A) above BANL is not permitted at all. Section 9.40.100(A) reduces each permitted level by 5 dB(A) where the offending noise is primarily impact, repetitive, or simple-tone noise. Measurements are taken at the affected property line on an A-weighted, slow-response meter under Sections 9.40.030 and 9.40.050, excluding extraordinary events like a passing train or airplane. Importantly, Section 9.40.060 says noise need not exceed these limits to be unlawful if it is otherwise a loud, unnecessary or disturbing noise. These are the city's standards; San Bernardino County's apply only to unincorporated areas.
Exceeding the Section 9.40.040 ambient levels beyond the durations allowed in Section 9.40.070, or violating the disturbance standard in Section 9.40.060, is a misdemeanor under Section 9.40.110 (up to $1,000 fine, up to six months in jail, or both, each day a separate offense), and may be abated as a public nuisance by injunction under Section 9.40.130.
