Kyle, TX Noise Ordinances: Barking Dogs (2026)

Kyle City Code § 23-60(5) lists among the city's noise nuisances the keeping of any animal or fowl which, by causing frequent or long continued noise, disturbs the comfort or repose of persons of ordinary sensibilities in the immediate vicinity thereof. The subsection does not name a particular animal, so it reaches a dog that barks repeatedly or for extended periods as readily as any other animal or fowl kept on a property. It falls under the broader § 23-60 nuisance declaration, which requires that the noise be of a character, intensity and continued duration that substantially interferes with a neighbor's comfortable enjoyment of a home, meaning an occasional bark is unlikely to qualify but a dog left barking for hours, or repeatedly across days, can.

Section 23-61 places responsibility on whoever controls the property where the animal is kept, whether an owner, tenant or boarding facility, for permitting or failing to control the nuisance while it occurs. Section 23-63 requires the city to order a reduction before citing if the disturbance is tied to protected activity, though that exception rarely applies to an animal noise complaint. The article was last adopted by Ordinance 775 on February 4, 2014, and its penalty in § 23-64 applies uniformly across every subsection of § 23-60.
