Commerce City, CO Noise Ordinances: Construction Hours (2026)

Section 6-2011(c) of the Commerce City Revised Municipal Code lists exemptions from the section's general ban on unreasonable noise, and item (2) covers construction equipment operating between the hours of 7:00 a.m. and 8:00 p.m. Within that fourteen-hour window, construction noise is not subject to the unreasonable-noise analysis at all; outside it, a contractor or property owner running equipment loses the exemption and the noise falls back under Section 6-2011(a), which lets city agents make a prima facie finding of unreasonableness based on the time of day, the size of any affected gathering, the neighborhood, and other disruption factors.

Section 6-2011(b) makes any resulting unreasonable noise unlawful, and it is unlawful to knowingly permit such noise on a premises or in a vehicle under a person's control. The same subsection (c) exemption list separately protects authorized emergency vehicles, city-sponsored activities, church or school bells, and city-permitted events, but construction equipment gets its own distinct time-bounded carve-out rather than a blanket pass covering every job site condition. A late-night or early-morning construction complaint in Commerce City is therefore enforced as a civil infraction under Section 6-1003, proven by a preponderance of the evidence in Commerce City Municipal Court or the city's administrative hearing process.
