Flagler County, FL Noise Ordinances: Construction Hours (2026)

Flagler County regulates construction noise two different ways depending on zoning, and both apply only in the unincorporated county, not inside Palm Coast, Flagler Beach, Beverly Beach, Bunnell or Marineland, each of which enforces its own code. Under the general noise ordinance at Sec. 22-55, unincorporated properties outside Industrial zoning are subject to maximum sound levels of 60 dBA (residential, 7:00 a.m. to 10:00 p.m.), 55 dBA (residential, nighttime), 70 dBA (commercial/office/institutional, daytime) and 65 dBA (commercial, nighttime), measured at the property line. But Sec. 22-56(6) exempts construction operations from those decibel limits outright, provided equipment carries standard mufflers and noise-reducing gear in proper operating condition, so there is no county-wide curfew on construction noise outside Industrial land.

Industrial-zoned property is carved out separately. Sec. 22-55(b) sends industrial noise to the Land Development Code, Section 3.03.18, the county's Industrial (I) district standards. There, industrial sound limits reach 75 dBA at all times measured at the property line, and construction noise is excepted from even that industrial limit only when building permits have been issued (or a written county agreement is in place), equipment runs to manufacturer specifications with mufflers engaged, and the work occurs between 7:00 a.m. and 6:00 p.m. Construction happening outside that window on Industrial land loses the exemption and must meet the underlying 75 dBA industrial sound limit like any other industrial noise source.

Sound is measured on the A-weighted scale with a slow time constant, and readings above the applicable table constitute prima facie evidence of a violation. The county's zoning map controls which use-occupancy category applies to a given parcel.
