Greece, NY Noise Ordinances: Construction Hours (2026)

Town Code Chapter 139 (Noise Control) sets the construction noise window in § 139-5. the next, no one may engage in or permit construction activities that create excessive noise at the construction site's property limits, regardless of the day of the week. A contractor who needs to work outside that window (for a concrete pour, a scheduling conflict, or similar hardship) must apply in writing to the Building Inspector or a designee, who may grant a variance after finding the applicant demonstrated hardship or practical difficulty and that the public interest is served.

The Building Inspector attaches whatever stipulations are needed for public health, safety and welfare, and the written variance must stay on site, available for any municipal official to inspect on demand. A separate emergency carve-out lets construction tied to abatement of a declared emergency (declared by the Building Department, Fire Marshal or Police Department) proceed without a variance for up to 72 hours from when the work starts, during which the contractor must apply for the variance retroactively. The chapter is enforced by the Chief of Police or a designee under § 139-7, and 'excessive noise' is defined elsewhere in Chapter 139 by reference to audibility beyond the site's property limits rather than a decibel meter reading.
