Section 101.05(A) states that noise created by any construction activity conducted during daytime hours is exempt from Chapter 101's noise standards. Section 101.01 defines 'DAYTIME HOURS' as the hours between 7:00 a.m. and 9:00 p.m., weekdays and Saturday, and the hours between 8:00 a.m. and 9:00 p.m. on Sunday, which is the operative window builders must stay inside to keep the exemption. The same definitions section defines 'CONSTRUCTION' as site preparation, assembly, erection, substantial repair, alteration or similar action, excluding demolition, so the exemption covers active building work but not demolition. Outside daytime hours, construction noise falls back under the general prohibition on excessive noise in Section 101.03(A) and the numeric noise-district tables in Section 101.03(C), plus the nighttime impulse-noise cap of 80 dB in Section 101.03(B). Section 101.05(C) separately exempts maintenance-equipment noise, public or private, only during those same daytime hours, showing the town applies one consistent daytime window across construction- and maintenance-related noise exemptions.
