Section 6-4 of the Hoover Code of Ordinances works through the permit itself rather than through a general noise clock. Under subsection (a), the building inspector or any other city official cannot issue a permit for the grading of property, or for the construction, demolition, improvement or addition to any building or structure in the city, unless the permit carries a printed legend limiting exterior work. The legend sets 6:00 a.m. to 9:00 p.m. Monday through Saturday and 8:00 a.m. to 5:00 p.m. on Sunday. Work inside the confines of the interior of a building or structure is carved out of the requirement, so interior finishing is not held to the legend.
Weekend hours can be cut back further. The building official or another city official can limit Saturday and Sunday hours based on proximity to and effect upon residential areas, churches and church related facilities. A contractor working next to a church cannot assume the full published window applies on a weekend.
Exceptions come in two forms. The legend itself allows a written exception from the building official or other official of the City of Hoover, and the application goes to the building official. Subsection (c) adds a second route for unusual or extraordinary circumstances, decided by the city building inspector. The inspector can grant the relief applied for only after finding either that additional time is necessary for the applicant to alter or modify the activity to comply, or that the activity, operation or noise source will be of temporary duration and cannot be done in a compliant manner, and also that no other reasonable alternative is available. The inspector can prescribe any conditions or requirements he deems necessary to minimize adverse effects upon the community or the surrounding neighborhood.
Any person aggrieved by the building inspector's decision can appeal to the council of the City of Hoover, and the council's decision is final.
Violations & Fines
Breaking the hours condition is cause to revoke the permit. The building inspector first notifies the violator and directs that the violation cease immediately. If the notice is ignored, the inspector is authorized to revoke the permit, and any work done after the violator receives notice of revocation is itself a violation. Under subsection (d) a violation is a misdemeanor punishable by a fine not exceeding $500, up to 180 days in the city or county jail, or both. Each day is a separate offense.
