Santa Cruz does not have a separate construction-hours chapter; construction noise is controlled by the general curfew in SCMC 9.36.010. Subsection (b) expressly lists noise made by 'construction' and by 'any appliance, contrivance, device, structure, construction, ride, machine, implement, or instrument' as 'offensive noise,' so construction activity that is loud or disturbing is prohibited between 10:00 p.m. and 8:00 a.m. Three narrow exceptions exist: (c) public-works contracts may start at 7:00 a.m. when the public works director determines the project could disrupt traffic or has time constraints; (d) emergency public-works contracts when authorized by the city manager; and (e) public or private construction projects may work during curfew hours only with the express written permission of the chief building official, public works director, planning and community development director, or water department director, and only for delineated tasks such as large concrete pours, movement of large materials or buildings, or utility-critical work. Contractors must notify all residents and owners within 300 feet.
