Both the owner of any instrumentality undertaking, using or causing the conduct, activity or conditions related to construction, property maintenance and landscaping work, ... as herein provided and its operator shall be deemed to be in violation of this chapter.

Full Breakdown

Section 78-4 of the Southampton Village Code opens with a finding by the Board of Trustees that noise from construction, property maintenance and landscaping unreasonably annoys, disturbs, injures or endangers the comfort, repose, health, peace or safety of others in the Village, and it declares work outside the permitted hours a public nuisance. The section was added on April 11, 2019 and amended on May 12, 2022 and December 12, 2024.

"Construction work" is defined broadly in § 78-4B(1)(a): any work done by employees or independent contractors under an oral or written agreement for compensation that involves the construction, reconstruction, erection, alteration, repair, addition to, demolition or removal of buildings or structures, or the excavation, clearing, filling or grading of land, or the placement or removal of earth, stone or building material. The hours rule in § 78-4B(1)(b) also covers deliveries in connection with construction work, so a delivery truck is held to the same clock as the crew.

Chapter 77 repeats the schedule from the noise side. Section 77-4A(2) exempts construction activities from the § 77-3 decibel limits between 8:00 a.m. and 6:00 p.m. Monday through Friday except public holidays as defined in the General Construction Law, and between 9:00 a.m. and 5:00 p.m. on Saturdays except public holidays, as long as the equipment complies with the rest of the chapter. That subsection was amended on July 11, 2024 by L.L. No. 25-2024. Pile drivers have a stricter rule in § 77-2C: none on Saturdays, Sundays and public holidays from Memorial Day through Labor Day. Emergency work by the State of New York, Suffolk County, the Town of Southampton, the Village or a recognized utility is exempt under § 77-4A(14).
