B. The following acts are declared to create a public nuisance during the times set forth herein: ... (3) Use of gas-powered leaf blowers. (b) Notwithstanding the above, gas-powered leaf blowers may be used when responding to an emergency or cleanup after a major storm but only during a state of emergency as declared by the Mayor of the Village of Southampton. C. Both the owner of any instrumentality undertaking, using or causing the conduct, activity or conditions related to construction, property maintenance and landscaping work, or the operation of gas-powered leaf blowers, as herein provided and its operator shall be deemed to be in violation of this chapter.

Under § 78-4B(2), paid property maintenance and landscaping work involving machinery or power tools, a list that names leaf blowers, is barred before 8:00 a.m. or after 6:00 p.m. on weekdays, before 9:00 a.m. or after 5:00 p.m. on Saturdays, and at all times on Sundays and federal and state holidays. Municipal employees can start at 6:00 a.m. for their regular and customary duties.

Section 78-5 sends violations of Chapter 78 to Article II of Chapter 1. Under § 1-17 a conviction is a violation under the New York Penal Law punishable by a fine not exceeding $2,000, imprisonment not exceeding 15 days, or both, plus community service if the court directs. Each day of a continuing violation is a separate offense. Under § 78-4C both the owner of the blower and its operator are in violation, and so is a property owner who causes, permits, suffers or allows its operation, with or without direct knowledge.
