In a residential district, § 77-3A allows airborne sound of no more than 65 dBA from 7:00 a.m. to 7:00 p.m. and no more than 50 dBA from 7:00 p.m. to 7:00 a.m. In a commercial district, § 77-3B allows no more than 70 dBA in the daytime period and no more than 55 dBA at night.
The district labels come from the definitions in § 77-1. Commercial district includes all zoning districts classified as business or industrial districts under Chapter 116, except the Hospital Accessory District and the Medical District. Residential district includes all residence districts plus those two excepted districts. A dBA is the A-weighted sound level measured by a general purpose sound-level meter complying with ANSI S1.4 1971, properly calibrated and operated on the A-weighting network.
Each period has a second test. Instead of the overall dBA figure, the sound can be measured by octave band sound-pressure level in decibels, and exceeding the printed value in one or more octave bands is also a violation. The tables run from 31.5 Hz through 8,000 Hz. The residential daytime table, for example, starts at 78 dB in the 31.5 Hz band and ends at 40 dB in the 8,000 Hz band.
Section 77-4 removes some sources from § 77-3, including agriculture, church bells, aircraft flight operations, snowblowers with a muffler, and the activities of any fire department or ambulance squad. Section 77-4B keeps those sources inside the noise pollution definition. Section 77-2A also forbids permitting a condition of noise pollution regardless of the decibel reading.
Violations & Fines
Section 77-6A refers violations to Article II of Chapter 1 of the Village Code, where § 1-17 sets a fine not exceeding $2,000, imprisonment not exceeding 15 days, or both, with community service in the court's discretion. Each day of a continuing violation is a separate offense. Section 77-6B adds that the Village may bring an injunction proceeding to enforce the chapter.
