Full Breakdown
Section 142-6C(3) of the Stafford Township Code sets the construction hours. Construction and demolition activity, excluding emergency work, cannot be performed between 6:00 p.m. and 7:00 a.m. on weekdays, or between 6:00 p.m. and 9:00 a.m. on weekends and federal holidays, unless the activity can meet the limits in Tables I and II. All motorized equipment used in construction and demolition activity has to be operated with a muffler. At all other times, the Table I and II limits do not apply to construction and demolition activities, so a crew working inside the permitted window is not measured against the decibel tables. Section 142-6B states the same exemption from the tables, except as provided in Subsection C.
Definitions in § 142-2 settle what the hours cover. Construction means any site preparation, assembly, erection, repair, alteration or similar action, including demolition of buildings or structures. Demolition means any dismantling, destruction or removal of buildings, structures or roadways. A weekday is any day that is not a federal holiday and runs from Monday at 7:00 a.m. to the following Friday at 6:00 p.m. A weekend begins Friday at 6:00 p.m. and ends the following Monday at 7:00 a.m. Emergency work is any work or action necessary to deliver essential public services, including repairing water, gas, electricity, telephone, sewer facilities or public transportation facilities, removing fallen trees on public rights-of-way, dredging navigational waterways or abating life-threatening conditions.
If a contractor does need to work in the restricted hours, the activity has to meet Table I. For a residential receiver outdoors that is 65 dB from 7:00 a.m. to 10:00 p.m. and 50 dB from 10:00 p.m. to 7:00 a.m., with indoor limits of 55 and 40 dB. Commercial or industrial power tools used on residential property are covered by a parallel rule in § 142-6C(2). Section 142-4 assigns enforcement to certified Stafford Township police or code enforcement officers.
Violations & Fines
A noise control officer issues an enforcement document under N.J.A.C. 7:29-1.6, and the contractor or owner is entitled to a hearing in a Municipal Court. Section 142-7B sets a civil penalty of not more than $1,000 for each offense. If the violation is of a continuing nature, each day during which it occurs is an additional, separate and distinct offense.
