'Construction' is defined in Section 40-3(g) as any activity necessary or incidental to erecting, demolishing, assembling, altering, installing or equipping buildings, highways, roads, utility lines or other property. Two exceptions apply under Section 40-6(b): emergency work and safety/protective devices, and domestic power tools that are instead governed by the separate power-equipment curfew in Section 40-15. Section 40-22 further exempts city departments performing their own governmental work from the Section 40-6 curfew, and lets the administrator (the police chief or a designee, per Section 40-3(a)) grant discretionary exemptions to other government bodies.
Enforcement runs through the administrator, who under Section 40-19 may order repair or alteration of noisy equipment, seal a violating device, or issue a cease-and-desist order, in addition to any criminal or civil penalty under Section 40-20.
Violations & Fines
A first violation is punishable by a fine up to $500.00, up to 15 days' imprisonment, or both, or a civil penalty up to $500.00 recovered by the city, under Section 40-20(1). Multiple violations on one day count as a single violation. If the violator holds a city license issued under Sections 4-46, 5-58 or 5-110, three or more chapter violations can trigger suspension or revocation of that license for up to six months under Chapter 5 procedures.
