Under Section 10-01-070(F), a violation is a public nuisance. A first offense is a civil citation with a civil penalty of up to $350. A second offense within a 24-month consecutive period carries a civil penalty of up to $600. A third offense in that period, and any later offense, is a Class 1 misdemeanor with a criminal fine of up to $1,000 and other allowable misdemeanor penalties. Each day a violation continues is a separate offense, and cases go to the Magistrate Court.
