Dublin controls industrial and commercial noise through the general nuisance standard in Municipal Code Chapter 5.28 plus the land-use noise-compatibility standards in the General Plan Noise Element. Dublin does not maintain a separate enforceable decibel ordinance for factories, warehouses, or commercial operations; instead it combines two tools. First, Chapter 5.28's nuisance standard (Section 5.28.020) applies to any person, including businesses, that makes loud, unnecessary, unusual, or habitual noise disturbing a reasonable person of normal sensitivity, with the zoning district and surrounding uses among the factors weighed. Second, the General Plan Noise Element sets land-use compatibility standards used when siting and conditioning development. Under that matrix (Table 9-1), commercial and industrial land uses are treated as "normally acceptable" at roughly 70 dB or less, "conditionally acceptable" around 71-75 dB, and less compatible above that, while sensitive residential uses must stay much quieter (about 60 dB or less "normally acceptable"). When a new or expanding industrial or commercial use is reviewed, the City can require acoustical studies, setbacks, screening, equipment limits, and conditions of approval to keep noise from intruding on nearby homes. Ongoing operational noise that crosses into a residential area and becomes an unreasonable nuisance can still be addressed under Chapter 5.28 even after a project is built. Truck loading, HVAC, generators, and similar equipment are common subjects of these conditions and complaints. Businesses should confirm the noise conditions attached to their use or site-development permit with Dublin Community Development.
Industrial or commercial noise that becomes an unreasonable nuisance is a misdemeanor under Chapter 5.28 (up to $500 and/or 30 days county jail, Section 5.28.030).
