Full Breakdown

Sec. 5-25(11) of the Cumberland County Code of Ordinances covers 'domestic power tools,' the category that includes leaf blowers along with saws, drills, grinders and other lawn and garden equipment. on weekends and holidays, unless the tool runs inside a building or structure so that the sound does not cross a residential property line or a posted noise sensitive zone and exceed the levels in the ordinance's Table 1 (60 dB(A) daytime/55 dB(A) nighttime for residential use). All such equipment 'shall be properly muffled and maintained in working order so as not to create excessive and unnecessary noise,' language that puts an affirmative maintenance duty on the owner, not just a time restriction.

Daytime leaf blower and lawn equipment use gets separate cover under the exemption at Sec. )' from the ordinance's Table 1 decibel ceiling entirely, so long as the equipment carries its manufacturer's standard mufflers and noise-reducing gear in proper operating condition. Outside that daylight window, or without mufflers in place, the tool falls back under the general prohibitions and decibel table. The Cumberland County Sheriff's Office enforces both sections under Sec. 5-31.

Violations & Fines

A violation of Sec. 9.5-25(11) draws a $100 civil penalty under Sec. 9.5-32(a)(1), due within 72 hours, and $150 for a second violation within 12 months. The offense can also be charged as a Class 3 misdemeanor under G.S. 14-4 with a fine up to $500, and each day of a continued running-hour violation is a separate offense.

Frequently Asked Questions

Can I use a leaf blower early in the morning in unincorporated Cumberland County?
Not before 6:00 a.m. on weekdays or 7:00 a.m. on weekends and holidays. Sec. 9.5-25(11) treats leaf blowers as 'domestic power tools' alongside saws and drills, barring their outdoor use between 10:00 p.m. and those morning cutoffs unless the sound stays inside a building and never crosses a neighbor's property line.
Is there a daytime exemption for lawn equipment noise levels?
Yes. Sec. 9.5-26(1) exempts lawn mowers and agricultural equipment run during daylight hours, 7:00 a.m. to 10:00 p.m., from the ordinance's Table 1 decibel ceiling, but only if the equipment still carries its manufacturer's standard mufflers and noise-reducing parts in proper working condition.
What if my leaf blower doesn't have a muffler?
Sec. 9.5-25(11) requires domestic power tools be 'properly muffled and maintained in working order so as not to create excessive and unnecessary noise.' An unmuffled tool that creates excessive noise can be cited even during otherwise allowed hours, and repeat violations raise the civil penalty from $100 to $150 within 12 months.
