Outdoor music in Davie is governed by Sec. 15-7(1) (radios, instruments and amplifiers) and Sec. 15-7(2) (loudspeakers and PA systems), plus the Sec. 15-4 land-use limits. Music creating a noise disturbance across a property boundary 7:00 p.m. to 7:00 a.m. is prohibited unless covered by a town-issued permit for a public event.
The Town of Davie does not have a separate 'outdoor music' section; outdoor music is regulated by the same provisions that cover amplified and unamplified sound. Under Sec. 15-7(1), operating or playing any radio, television, phonograph, drum, musical instrument, sound amplifier or similar device that creates a noise disturbance across a real property boundary or within a noise sensitive zone between 7:00 p.m. and 7:00 a.m. is a violation, except for activities open to the public for which the Town of Davie has issued a permit. Under Sec. 15-7(2), loudspeakers and public address systems are restricted: noncommercial use between 8:00 p.m. and 7:00 a.m. that disturbs a residential boundary or noise sensitive zone; and commercial use either any time it creates a disturbance across a property boundary or in a noise sensitive zone, or between 8:00 p.m. and 7:00 a.m. on a public right-of-way. During daytime hours, outdoor music remains subject to the Sec. 15-4 limits for the receiving land use (for example, 55 dBA in residential areas). Section 15-8(10) exempts noise from a town-sanctioned event at the Bergeron Rodeo Grounds, and Sec. 15-5 affords extra protection within 500 feet of hospitals, schools, parks, churches and courtrooms.
Outdoor music complaints go to Davie Code Compliance at 954-693-8237 and are enforced via the Special Magistrate under Chapter 6 and Florida Statutes Chapter 162. After a notice and compliance deadline, continued violations can result in fines of up to $1,000 per day, and up to $5,000 per day for repeat violations. Public events may require a permit.
