The Town of Davie addresses industrial and stationary equipment noise both by land-use limits and by specific prohibitions. Under Sec. 15-4 Table 1, the Industrial/Utilities receiving land use is limited to 65 dBA at all times, and Office/Business to 60 dBA at all times, measured at the receiving boundary. Beyond those measured limits, Sec. 15-7(11), Engines, generators, pumps, motors and other machinery, makes it unlawful to operate any engines, generators, pumps, motors or other machinery, including air conditioning and air-handling equipment, so as to cause a noise disturbance at any time. Sec. 15-7(9), Vibration, prohibits operating any device that creates vibration above the vibration perception threshold of an individual at or beyond the property line if on private property, or 50 feet from the source on a public space or public right-of-way. Sec. 15-7(13), Noise from buildings or premises, bars using a building or premises for any business or use that is, by its boisterous nature, excessive or unusually loud and disturbs the peace of the neighborhood. Section 15-6 reduces the applicable limits by 5 dBA for pure-tone sources. Stationary equipment owners may seek relief through a special variance under Sec. 15-11 for activities listed in Sec. 15-7(8) and (14).
Industrial and equipment noise is enforced by Davie Code Compliance (954-693-8237) through the Special Magistrate under Chapter 6 and Florida Statutes Chapter 162. After a notice and deadline, continued violations can carry fines of up to $1,000 per day, and up to $5,000 per day for repeat violations, plus possible code liens.
