Quiet hours in Davie, FL โ also called the noise ordinance, nighttime noise rules, or residential quiet time โ define the hours during which excessive noise is prohibited.
Davie's noise code sets nighttime sound limits and bans many noise-producing activities between 7:00 p.m. and 7:00 a.m. In residential areas the maximum permissible sound level drops to 50 dBA at night, down from 55 dBA in the daytime, measured at the receiving property's boundary.
The Town of Davie regulates nighttime noise through Chapter 15 of its Code of Ordinances (Ord. No. 88-59, as amended). Section 15-4 establishes maximum permissible sound levels by receiving land use. For residential land use, the limit is 55 dBA from 7:00 a.m. to 7:00 p.m. and 50 dBA from 7:00 p.m. to 7:00 a.m., measured at the boundary of the receiving property. A sound exceeds the limit only if it does so for more than fifty percent of any measurement period of at least ten minutes. Beyond the decibel table, Section 15-7 lists specific acts prohibited regardless of measured level. Several are tied to the 7:00 p.m. to 7:00 a.m. window, including playing radios, televisions or instruments across a property boundary, handling boxes and garbage cans, and operating domestic power tools in residential areas. Loudspeakers and public address systems for noncommercial use are restricted between 8:00 p.m. and 7:00 a.m. (Sec. 15-7(2)(a)). Lawn maintenance devices are barred between 8:00 p.m. and 7:00 a.m. (Sec. 15-7(15)). Enforcement is handled through the town's code compliance process and Special Magistrate under Chapter 6.
Violations are enforced under Chapter 6 through the Town's Special Magistrate process pursuant to Florida Statutes Chapter 162. After a notice of violation and a compliance deadline, continued violations can carry fines of up to $1,000 per day, and up to $5,000 per day for repeat violations, plus possible code liens.
