The decision-maker can only approve an exception if the applicant shows the activity would not be detrimental to community health, safety, or welfare, weighing duration and proximity to 'sensitive receptors' (residences, schools, hospitals, churches, etc., as identified in the General Plan noise element). Reasonable conditions on sound level, duration, and operating hours may be attached. Notably, public and private schools and school-sponsored activities are exempt from the chapter entirely under EMC 8.52.020(5).
Outdoor or live music outside these limits is a Chapter 8.52 violation enforced under EMC 8.52.100 ($500/$750/$1,000 minimum fines, infraction escalating to misdemeanor, each day separate). Running a continuous outdoor-event use without an approved exception risks citation once any 180-day grace period for a pending exception application (EMC 8.52.070(4)) has lapsed.
