Eastvale Municipal Code 8.52.040 sets numeric exterior sound-level limits (dB Lmax) by land use: 55 dB day / 45 dB night for residential, 65 / 55 for most commercial, and 75 dB for industrial. Measurements are taken on the receiving occupied property with a calibrated sound-level meter.
Eastvale uses a true decibel-based noise standard, set out in the Table 1 (Sound Level Standards, dB Lmax) of EMC 8.52.040. No person may create sound that causes the exterior sound level on another occupied property to exceed the table's limits. The table keys limits to the General Plan land-use designation of the affected property and splits the day into 7:00 a.m.-10:00 p.m. and 10:00 p.m.-7:00 a.m. periods. All residential designations (estate, very low, low, medium, medium-high, high, very high, and highest density residential) are capped at 55 dB Lmax daytime and 45 dB Lmax nighttime. Retail, office, tourist, and community-center commercial are 65 day / 55 night. Light industrial is 75 day / 55 night; heavy industrial is 75 dB around the clock. Business park and public facility are 65 day / 45 night. Rural residential, rural mountainous/desert, agriculture, and most open-space designations are 45 dB both day and night. Measurements use 'Lmax' (maximum sound level) on an ANSI Type 1 or Type 2 sound-level meter and may be taken anywhere within the boundaries of the receiving occupied property, at the discretion of the enforcing official (EMC 8.52.050). The meter must be calibrated immediately before and reverified after each measurement, with annual certification of the meter and calibration equipment. These general limits apply to all sound sources, including the special sources in EMC 8.52.060.
Exceeding the EMC 8.52.040 limits is a violation of Chapter 8.52, prosecuted under EMC 8.52.100: an infraction for the first or second violation in 180 days ($500 then $750 minimum), and a misdemeanor for more than two ($1,000 minimum and/or up to six months in jail). Each day of violation is a separate offense. EMC 8.52.090 also makes it unlawful to refuse to cooperate with enforcement officials, who may require a person to shut off a sound source so it can be measured.
