Full Breakdown
Three paragraphs of § 404.02 address noise from the vehicle itself. Subsection (a), headed Horns, audible signaling devices, etc., says no person shall sound any audible signaling device on any vehicle except as a warning of danger. Subsection (b), Exhaust, says no person shall discharge the exhaust or permit the discharge of exhaust of any steam engine, stationary internal combustion engine, motorboat, motor vehicle or snowmobile except through a muffler or other device that effectively prevents loud or explosive noises, and that complies with all applicable state laws and regulations.
The muffler rule therefore reaches more than cars: boats, snowmobiles and stationary engines are named. Subsection (c), Defective vehicles or loads, says no person shall use any vehicle so out of repair or so loaded as to create loud and unnecessary grating, grinding, rattling or other noise. The code prints no decibel reading for any of the three, so enforcement rests on whether the noise is loud, explosive or unnecessary as described. Amplified music from inside a car has its own paragraph, (h), which uses a 50 foot audibility test on a public street or alley, and the 10:00 p.m. to 7:00 a.m. plainly audible presumption in (e) is separate.
Section 404.03(a) also bars driving or operating a minibike or other recreational vehicle not licensed for public highways between 9:00 p.m. and 7:00 a.m., and § 404.03(e) ties snowmobile hours to section 604.03. Anyone expecting a one-time exceedance can ask the city council for a variance under § 404.05 before the act.
Violations & Fines
Chapter 404 has no fine schedule, so the § 102.01(a) general offense applies: a misdemeanor punishable by a fine not to exceed $1,000.00, imprisonment not to exceed 90 days, or both, with costs of prosecution. Section 404.06(a) also allows the city to enforce the chapter by injunction, action for abatement or other appropriate civil remedies in addition to criminal penalties.
