Fayetteville Fire Code (Code of Ordinances Chapter 12, Fire Protection) adopts the North Carolina State Fire Prevention Code, which incorporates the International Fire Code (IFC) as modified by the NC Building Code Council. IFC 308.1.4 prohibits open-flame cooking devices and LP-gas tanks over 1 pound on combustible balconies of multi-family buildings of three or more units, and within 10 feet of combustible construction. Exceptions exist for sprinklered NFPA 13/13R buildings.
Fayetteville Code of Ordinances Chapter 12 (Fire Protection) adopts the North Carolina State Fire Prevention Code, currently based on the 2018 International Fire Code (IFC) with NC Building Code Council amendments. IFC Section 308.1.4 (Open-Flame Cooking Devices) prohibits charcoal burners, other open-flame cooking devices, and LP-gas containers larger than 1 pound on combustible balconies and within 10 feet of combustible construction in buildings with three or more dwelling units. Exceptions apply where buildings are fully protected by automatic sprinklers per NFPA 13 or 13R, or where balconies and decks are of non-combustible construction. Single-family detached homes in Haymount, Vanstory Hills, Westover, Eutaw, and Massey Hill face no equivalent prohibition for backyard use, but reasonable clearance from siding and overhangs is required. North Carolina has standardized fire code enforcement: NCGS 143-138 grants the Building Code Council statewide jurisdiction; locals enforce but cannot adopt stricter fire code rules unless authorized. Fayetteville Fire Department (FFD) handles enforcement and inspections. Multi-family communities around Fort Liberty (Cross Creek Mall area, Westwood, Cliffdale) commonly have stricter no-grill rules in leases. Hurricane evacuation periods (Hurricane Florence aftermath patterns) often see propane tank theft and damaged tank advisories.
Chapter 12 fire code violations carry civil penalties under NCGS 143-138(e) and local enforcement, plus possible misdemeanor charges in egregious cases. The Fire Marshal may issue immediate stop-use and abatement orders. Insurance loss following grill-caused fires creates separate civil liability. Lease violations supporting eviction proceed through NCGS Chapter 42.
