Kalamazoo, MI Outdoor Cooking: Smoker Rules (2026)

Amended Section 308.1.4 of the Fire Prevention Code, adopted under § 15-41 of the Kalamazoo City Code, states that charcoal burners and other open-flame cooking devices shall not be operated on combustible balconies or within 10 feet of combustible construction, decorations, or furnishings. That 10-foot clearance applies to grills, smokers, and any similar device that burns charcoal or an open flame, and it targets balconies and multifamily settings where a grill sitting against a wood railing or vinyl siding is a common fire-start point. A companion provision, added Section 308.1.4.1, bars operating any open-flame cooking device over a public right-of-way or over the property of others, closing off the workaround of grilling from a balcony out over a sidewalk, alley, or a neighbor's yard.

Both amendments fall under Article III, Fire Prevention Code, which the City readopted in its entirety effective December 19, 2022, under Ordinance No. 2058, adopting the 2021 International Fire Code with local amendments. The Bureau of Fire Prevention within the Department of Public Safety, whose inspectors are detailed by the Chief of the Department of Public Safety subject to City Manager approval, enforces the section, and the Chief of the Department of Public Safety may modify strict compliance under § 15-44 upon written application showing practical difficulty, provided public safety is still secured.

Someone cited for the balcony or right-of-way rule can appeal a permit or code-interpretation decision to the Building Board of Appeals within 30 days under § 15-46.
