Chapter 39 restricts outdoor light fixtures that emit undesirable rays into the night sky, per the intent stated in Sec. 1. Sec. building facade and landscape lighting) also prohibits non-sodium lamps above 4,050 lumens. Permitted fixtures must be fully shielded where feasible, partially shielded otherwise, and focused to minimize light directed skyward. Sec. and sunrise; and searchlights for advertising are banned outright. Sec. 5(d), added by Ord. No. 24-OR0151-1 in 2024, limits residential dwellings and small multifamily buildings of three units or fewer to a narrower light-trespass rule: fixtures must be shielded or angled so no direct illumination crosses the property line, with violations of that rule deemed a nuisance, and those small residential properties are otherwise exempt from the rest of Chapter 39.

Sec. 9 exempts fixtures legally installed or permitted before the effective date (except for the hours-of-operation rules), combustion-fuel fixtures like kerosene lanterns, seasonal holiday lights, and temporary law-enforcement or emergency lighting. The building director reviews compliance evidence under Sec. 7 before issuing permits for nonexempt fixtures.
