01 defines an ABANDONED MOTOR VEHICLE as one inoperable and left unattended on public property more than 48 hours, illegally on public property more than 48 hours, on private property without the property owner's or controller's consent for more than 48 hours, or left on a designated highway right-of-way more than 48 hours. A JUNKED VEHICLE is self-propelled, lacks a current license plate or valid inspection certificate, and has been wrecked, dismantled or inoperable for more than 72 consecutive hours on public property or 30 consecutive days on private property.

02, the city may take an abandoned vehicle into custody from public or private property, must notify the last known registered owner and lienholders by certified mail within 10 days per Tex. Transp. 012, and after 20 days without reclamation and payment of towing, preservation and storage charges may sell it at public auction. Proceeds first reimburse auction, towing and storage costs, with any remainder held for the owner or lienholder for 90 days before going to a special fund covering future abandoned-vehicle costs. The city may also apply to the State Highway Department to dispose of a vehicle to a demolisher under Tex.

Transp. 051. 03 allows only one junked vehicle on private property, and only if it is stored inside a code-compliant building; otherwise it is declared a nuisance. Removal requires 10 days' written notice by certified mail to the owner or occupant, with the right to demand a hearing before the Municipal Judge, who orders removal if the vehicle is found to be a nuisance, and the city must notify the State Highway Department within 5 days of removal.
