Full Breakdown

AVMC 9.04.090 applies to "any oversized vehicle upon any city street or highway." The definition sits in AVMC 9.02.030 and has five prongs: any vehicle longer than 24 feet; any vehicle weighing more than 10,000 pounds; a vehicle used for transporting persons for hire, compensation or profit, or for transporting property, including buses, motor trucks, trailers, semitrailers, trailer coaches or truck tractors, wider than 84 inches at the widest part of the body not counting mirrors; any similar vehicle or recreational vehicle wider than 84 inches; and any farm machinery or special purpose machinery.

The night limit and the day limit are separate. Nighttime parking is barred between 2:00 a.m. and 6:00 a.m. on two consecutive days. Daytime parking is barred between 6:00 a.m. and 2:00 a.m. for more than 12 consecutive hours on two consecutive days. Moving a few feet does not reset the clock: the code defines "park" or "leave standing" to include failing to move a vehicle at least one-tenth of a mile on the odometer, or at least 100 feet axle to axle when there is no odometer reading.

Subsection (C) lists three exceptions: active loading or unloading, including preparing the vehicle for travel or storage and up to 12 hours when the vehicle cannot reasonably be taken on the road or moved to lawful storage; being parked in connection with a service to a property in the same block; and emergency repairs on the vehicle itself. Authorized emergency vehicles are exempt. Ordinance 2025-247 amended the section.

Other street limits stack on top. AVMC 9.04.040(C) bars any vehicle on a city street longer than 72 consecutive hours, and AVMC 9.04.070 authorizes removal at 72 or more consecutive hours. The public works director can issue permits for variations from the California Vehicle Code Division 15 size, weight and load limits under AVMC 9.04.120, with a fee set by council resolution and security the director can require. Chapter 9.08, titled Advertising on Parked Vehicles, presumes a commercial vehicle parked in the same space for more than four hours is not engaged in its ordinary business.

Violations & Fines

Violating the oversized vehicle section is punishable under AVMC 1.06.010: a misdemeanor with a fine of up to $1,000, six months in jail, or both, unless the city attorney proceeds by infraction at not more than $100 for a first violation, $200 for a second within one year and $500 for each additional one. Each day is a separate offense under AVMC 1.06.020, and a vehicle left 72 or more consecutive hours is subject to removal.

Frequently Asked Questions

What counts as an oversized vehicle in Aliso Viejo?
AVMC 9.02.030 covers any vehicle longer than 24 feet or heavier than 10,000 pounds, buses, trucks, trailers and similar vehicles wider than 84 inches, recreational vehicles wider than 84 inches, and any farm or special purpose machinery. Width is measured at the widest part of the body, not counting mirrors.
Can I park a work truck on my street overnight?
Only if it falls outside the oversized definition or an exception applies. Oversized vehicles cannot be parked on city streets between 2:00 a.m. and 6:00 a.m. on two consecutive days. The exceptions are active loading or unloading, service to a property in the block, and emergency repairs on the vehicle.
Does moving my truck a few feet restart the time limit?
No. AVMC 9.02.030 says parking or leaving standing includes failing to move a vehicle at least one-tenth of a mile as measured on the odometer. Without an odometer reading, the vehicle must move at least 100 feet, measured axle to axle, from its last marked location.
Can the city allow a heavier or larger vehicle on its streets?
Yes, through a permit. AVMC 9.04.120 authorizes the director to issue permits for variations from the size, weight and load limits in California Vehicle Code Division 15. The fee is set by city council resolution, and the director can require security to protect highways and bridges from injury.
