Full Breakdown

Town Code § 202-64 defines a wide set of covered vehicles, including any "motor-driven vehicle registered as a commercial vehicle or used for commercial purposes," trucks ("designed, used or maintained primarily for the transportation of property"), buses, tractors, trailers, semitrailers, house coaches and taxicabs. of any day. Three exceptions apply: authorized emergency vehicles and public utility or contractor vehicles engaged in repair, maintenance, inspection or construction of streets or utilities (Subsection C); vehicles actively loading or unloading merchandise or passengers, or providing services to a resident or business (Subsection D); and the Town is required to post notice of the restriction at entry roads and highways (Subsection E).

The chapter's general penalty provision, § 202-62, was last amended October 2, 2008 by Local Law No. 75-2008, effective October 10, 2008, and applies townwide to Chapter 202 offenses, including night parking violations, unless a more specific penalty is enacted for that article. Because the ban covers the whole town outside its incorporated villages, a truck driver working in one of Hempstead's many villages (Freeport, Rockville Centre, Garden City, and others) is instead subject to that village's own separate parking code, not this section.

Violations & Fines

Violating the overnight truck/bus/trailer parking ban is a traffic infraction under § 202-62, punishable by a fine of not more than $500, imprisonment of not more than 15 days, or both. Tickets can be issued for any commercial vehicle, house coach, livery vehicle, semitrailer, taxicab, tractor or trailer found parked or standing on a town street between midnight and 6:00 a.m. without an applicable exception.

Frequently Asked Questions

Can I park my box truck on a Hempstead street overnight?
No. Town Code § 202-64(B) makes it unlawful to park or leave standing any commercial vehicle, truck, trailer, bus or similar vehicle on a town street, roadway or public highway between midnight and 6:00 a.m. Signs are posted at entry points warning of the restriction.
Is there an exception for a delivery truck making a drop-off?
Yes. Subsection D exempts vehicles engaged in loading or unloading merchandise or passengers, or providing a service to a resident or business, from the overnight parking ban even during the restricted hours.

It is a traffic infraction under § 202-62, carrying a fine of up to $500, imprisonment of up to 15 days, or both, for each offense against the chapter.

No. The Town Code governs only the unincorporated areas and villages that adopt town traffic law by reference; the incorporated Village of Hempstead and other villages within the town enforce their own separate parking codes.
