Curb and pavement markings that control parking are official traffic-control devices installed only by the government. In Pensacola the public works director plans and maintains them; in Escambia County fire and emergency lanes must carry official red or yellow markings. Residents may not paint curbs to reserve parking.
In the City of Pensacola, § 11-2-3 gives the director of public works and facilities the duty to plan, install and maintain traffic-control devices and direct parking on city streets, so a resident cannot paint a curb to create a no-parking or reserved space. In Escambia County, § 94-97 provides that fire or emergency lanes where parking is banned must be posted with a permanent sign or permanent painted pavement markings in red or yellow, meaning such markings are official and government-placed. Unauthorized curb painting is not enforceable and can be treated as defacing public property.
Ignoring official curb or lane markings is a parking violation; painting or altering a public curb without authority may be treated as damaging or defacing public property.
