Full Breakdown

Kane County Code Chapter 28, Article II governs charging-station parking on county property. Section 28-2-2-1 states that charging station spaces are reserved for use by electric vehicles only, while EVs themselves may park in any regular space subject to the same restrictions as any other vehicle. Section 28-2-2-2 makes it unlawful for a nonelectric vehicle to park or stand in a designated charging station space once a sign authorized under Section 28-2-2-3 provides notice of the restriction; that vehicle is subject to fine and/or impoundment.

Section 28-2-2-3 puts the Kane County Engineer in charge of installing the signs and pavement markings, which must state any time limits and hours of operation and declare the space reserved for EV charging only. Section 28-2-2-4 sets the penalty: any violation of the article is punishable as an ordinance violation, fined under Chapter 21, Article II, Sections 21-11 and 21-14 (the county's parking-violation schedule, which sets prohibited-parking fines at $15 if paid within 48 hours or $30 after), and each hour the violation continues is a separate offense.

Article I of the same chapter governs where charging equipment may be installed: Level 1 and Level 2 stations are permitted in every zoning district as an accessory use, with Level 2 installation requiring a building permit (28-1-2-1), while Level 3 DC fast chargers are limited to the RB, B1, B2, B3, B4, LI, I, PUD and A-2 districts (28-1-2-2). ).

Violations & Fines

Parking a nonelectric vehicle in a posted charging station space violates Code 28-2-2-2 and is punishable as an ordinance violation under 28-2-2-4, fined per the Chapter 21 parking-violation schedule (Sections 21-11, 21-14), which lists a $15 prohibited-parking fine if paid within 48 hours, rising to $30 after. The offending vehicle is also subject to impoundment, and each hour the violation continues counts as a new, separately punishable offense.
