Sec. 74-85(b) and Sec. 59-16(f) of the North Port Code allow parallel parking of motor vehicles on the berm, shoulder, or swale right-of-way adjacent to a residential lot, but only if vehicles are licensed, parked in the direction of traffic, and don't damage the drainage swale.
Ordinance 2018-09 rewrote Sec. 74-85(b) to require parallel parking on the right-hand side of the roadway, headed with the flow of traffic, and prohibits non-resident vehicles from parking on a homeowner's right-of-way without express permission of the owner. Vehicles must be licensed (registered). Trucks, buses, truck tractors, trailers, boats, and RVs are barred from parking on the berm/shoulder/swale ROW area (Sec. 59-16(f)(4)). If a property owner is at fault for swale damage and doesn't repair it within 30 days of written notice, the City will repair it and bill the owner; unpaid bills become liens after 60 days (Sec. 59-16(f)(3)).
Parking ticket fines are paid within 10 days at the Police Department (Sec. 74-84). Each day a violation is unpaid constitutes a separate violation. Swale-damage cost recovery follows the Sec. 42-24 nuisance-abatement process.
