Full Breakdown

Section 9403 of the Arcadia Property Maintenance and Nuisance Abatement Code does three things. It makes substandard and unlawful conditions public nuisances, it makes the owner, responsible party, lessee, occupant or anyone with a legal interest responsible for keeping a lot or parcel free of them, and it makes maintaining property in a substandard condition unlawful. Section 9402.6 defines substandard. The list includes an unsafe building or structure under Section 116 of the California Building Code, a partially constructed building where work has stopped for more than sixty days, unoccupied buildings left open or unlocked, and unsightly partly completed or partly destroyed buildings that endanger neighbors or the public. Chapter 12 of Article VIII separately adopts the 1997 Uniform Code for the Abatement of Dangerous Buildings (Section 8960).

Enforcement runs through Section 9404. The Building Official or Code Services staff serve a written Notice of Violation that lists each violation, orders correction within 14 days (or sooner if the condition is a hazard to public health or safety), and warns that the City will charge administrative costs. The owner has fourteen days to appeal in writing to the Director, who holds a hearing, and the Director's decision is final (Section 9404.3). The City can record the Notice of Violation with the County Recorder as constructive notice to later owners (Section 9404.4). Conditions that cannot be tied to a responsible party, or that create an imminent risk, are subject to summary abatement by City forces (Section 9404.6).

Costs follow the property. Section 9405 makes the owner and any responsible party liable, with an itemized invoice and a hearing request window of 10 days. Unpaid costs become a special assessment after thirty calendar days, or the City can record an abatement lien with the Los Angeles County Recorder.

Violations & Fines

Under Section 9404.5, ignoring a final order is a misdemeanor or an infraction punishable under Section 1200 of the Arcadia Municipal Code, and the Building Official can also abate the nuisance by rehabilitation, demolition or repair. Refusing an inspector's right of entry is a misdemeanor (Section 9404.1). The owner pays enforcement and abatement costs, and a prevailing party can recover attorneys' fees if the City elects to seek its own.

Frequently Asked Questions

What is a substandard property in the City of Arcadia, California?
Section 9402.6 defines it. Examples include an unsafe building under California Building Code Section 116, unfinished construction where work stopped for more than sixty days, open or unsecured vacant buildings, faulty weather protection, weeds, and stored debris. Under Section 9403 every such condition is a public nuisance the owner must cure.
How long do I have to fix a violation after a notice?
The Notice of Violation orders correction and abatement within 14 days from the date of the notice, or a shorter time if the violation is a hazard to public health or safety. You also have fourteen days to file a written appeal with the Development Services Director, who then holds a hearing.
Can the City clean up the property itself?
Yes. Section 9404.6 allows immediate summary abatement by City forces when responsible parties cannot be readily found or the condition creates an imminent risk to public health, safety and welfare. The costs are assessed to the responsible parties, and Section 9405 lets the City recover them by special assessment or lien.
What happens if the abatement bill goes unpaid?
If the cost is not paid within thirty calendar days after it becomes final, it becomes a special assessment against the parcel, collected with property taxes and with interest at the legal maximum rate. The City can also record a nuisance abatement lien with the Los Angeles County Recorder, which carries the priority of a judgment lien.
