Abington, PA Public Conduct: Outdoor Smoking Restrictions (2026)

Township Code § 115-5, added in 1996 and amended by Ordinance No. 2123 in 2016, defines "prohibited areas" as "any Township-owned park or playground area" and bars "smoking, including the use of smoking alternative products such as e-cigarettes, and tobacco use in any form" once those areas carry a posted "No smoking" and/or "No use of e-cigarette" sign. The section's definitions sweep broadly: "smoking" covers possession of a lighted cigarette, cigar, pipe, e-cigarette, vaporizer or other lighted smoking instrument or smoking alternative, and "tobacco use" covers smokeless tobacco and tobacco substitutes as well.

The Fire Official, defined as the Township Fire Marshal or a designee, controls the content, lettering, size, color and placement of the required signs under § 115-5C, and it is separately unlawful to obscure, deface, mutilate or destroy a posted sign. Because the ban is triggered by signage rather than applying automatically by its own force, enforcement in practice tracks wherever the Fire Marshal has posted a park or playground, and township practice is to post the required signage throughout its park system.
