6(b). The ordinance sits alongside the companion Sec. 24-12, which separately restricts smoking in multi-unit housing, so a resident's private balcony is governed by a different section than the parks and sidewalks covered here.
Violations & Fines
Smoking where prohibited is an infraction under Sec. 24-11.6(g): a fine up to $100 for a first violation, up to $200 for a second within a year, and up to $500 for each further violation within a year. The City Attorney can also bring a civil action carrying a fine between $250 and $1,000 per violation under Sec. 24-11.6(h), and Sec. 24-11.6(i) lets a private citizen sue to enforce the ban directly.
