Bonita Springs, FL Public Conduct: Outdoor Smoking Restrictions (2026)

Section 28-37(e) of the Bonita Springs Code sits in the parks article of chapter 28 and has three working parts. First, it borrows the Clean Indoor Air Act: no person can smoke within the confines of the recreation centers and community buildings, or at any other posted location the Act covers. Second, it gives the parks and recreation director the power to designate areas where smoking is not permitted so that youth activities can run, and it names playgrounds, fields, bleachers and dugouts during games and youth practice time as examples. Third, in any area where smoking is prohibited, the director can designate a smoking area, so a restriction at a facility is not always a total ban on the site.

The text does not ban smoking on every acre of every park. Outside the recreation buildings, the posted Clean Indoor Air Act locations and the youth-activity areas the director designates, section 28-37(e) does not itself prohibit it. Because the director's designations control the youth areas, the answer at a given field is whatever the posted signs say. Section 28-37(i) reinforces this by making it an offense to engage in any activity that a posted sign expressly prohibits, with its own fine line of $150, $300 and $500.

A separate rule, section 28-38, forbids possessing, consuming or using alcoholic or intoxicating beverages or illegal substances in any park, with fines of $100, $200 and $500. That section is distinct from the smoking rule and does not turn on the Clean Indoor Air Act. Both sit in the same article, so the same enforcement tools, expulsion power and fine schedule apply.
