Cape Coral, FL Public Conduct: Outdoor Smoking Restrictions (2026)

Cape Coral's park-specific smoking rule, § 12½-4(v), splits into two parts. The first is absolute and covers indoor space: smoking is prohibited in all enclosed areas and facilities at every city park, with no permit or designated-area exception written into the text. The second reaches outdoors, but only around ballfields: smoking is also prohibited in bleacher areas and dug outs in and around ballfield areas, so a spectator can't light up in the stands or dugout while watching a game, even though the field itself is open air.

Outside those two zones, open picnic lawns, walking trails, or general park grounds away from ballfields, this particular subsection doesn't reach; smoking there is regulated, if at all, by state law rather than this park ordinance. The same enclosed-space logic runs through the city's separate facility rules at § 12-143(a)(3), which bars smoking, vaping, and lit tobacco products inside all city-owned, controlled, and leased buildings citywide, not just parks. Enforcement of the park smoking ban falls to Law Enforcement Officers as § 12½-2 defines the term, police officers, park rangers, and Code Enforcement Officers, who can direct a violator to stop and leave under § 12½-4(g)(11), with resistance or abuse toward the officer a separate violation under § 12½-4(g)(12).

Chapter 12½ carries no dedicated fine for smoking violations, so enforcement defaults to the citywide general penalty at § 1-14: $100 to $500, up to 60 days in jail, or both, with each day a violation continues counted as its own offense.
