Cape Coral, FL Public Conduct: Skateboarding Rules (2026)

Cape Coral treats skateboarding as its own category of park rule, separate from the vehicle-traffic provisions in § 12½-4(h). Section 12½-4(i) confines the activity to hard surfaces: a skateboard may only be used or operated on asphalt or concrete walkways or trails inside a city park, or in a spot which may hereafter be designated by the city as skateboard areas. Everything else, sports courts, grass fields, playground surfaces, landscaped areas, sits off-limits to skateboards by default unless and until the Parks and Recreation Department posts it as a designated skateboard area.

The rule sits within Article I of Chapter 12½, first established under Ord. 73-97 on October 27, 1997, in furtherance of the chapter's stated purpose at § 12½-1 to promote the public health, safety and welfare of park users. Enforcement runs through the same Law Enforcement Officers defined in § 12½-2, police officers, park rangers, and Code Enforcement Officers, who can order a skateboarder off a prohibited surface under § 12½-4(g)(11), and § 12½-4(g)(12) makes resisting or being abusive toward that officer a separate offense.

Because subsection (i) doesn't set its own fine, a violation defaults to the citywide general penalty at § 1-14: a fine of $100 to $500, up to 60 days in jail, or both, with each day a violation continues counted as its own separate offense.
