Broomfield, CO Public Conduct: Outdoor Smoking Restrictions (2026)

Chapter 8-02, Smoking in Public Places, was rewritten by Ord. No. 2104 in 2019 to fold vaping into the smoking ban. Section 8-02-020(C) defines 'electronic smoking device' broadly, covering e-cigarettes, e-cigars, e-pipes, e-hookahs, and vape pens, and § 8-02-020(F) states that 'smoking' includes both burning tobacco and the use of an ESD. Section 8-02-030 lists six locations where smoking is banned outright: anywhere Colorado law already forbids it, any park as defined in § 12-28-030, any public transit waiting area, any public event requiring a city permit, any outdoor area used for athletic or sporting activity by or for the public, and any outdoor patio, dining, or bar area open to the public.

Ordinance No. 2212 in 2023 refined the definitions supporting that list. Businesses and event operators must post signage under § 8-02-070: letters at least one inch high, or symbols at least three inches high, reading 'No Smoking' or displaying the international no-smoking symbol at every public entrance or clearly visible on entry. Section 8-02-080 puts compliance on the owner, lessee, principal manager, or person in charge of the regulated premises, not just the smoker. Broomfield Public Health and Police enforce the chapter; earlier sections banning smoking inside restaurants, taverns, and workplaces (former §§ 8-02-040 through 8-02-060) were repealed by Ord.

No. 2104 in 2019 because state law had already occupied that ground, leaving the outdoor and public-place list in § 8-02-030 as the operative city rule.
