Cherry Hill, NJ Public Conduct: Outdoor Smoking Restrictions (2026)

Ordinance No. 2012-25, codified at Township Code § 5-8, prohibits smoking within the boundary of any land owned, maintained or possessed by Cherry Hill Township, Camden County, New Jersey. The list of covered properties in the ordinance itself names all parks, playgrounds, and active and passive recreational facilities, along with the Municipal Complex, the Department of Public Works grounds, the Cherry Hill Public Library, Croft Farm, and the Historic Barclay Farmstead, so the ban reaches Township buildings and parking areas, not just green space. 1 defines 'to smoke' broadly as burning, inhaling from, or exhaling smoke from a lighted cigar, cigarette, pipe, or other paraphernalia used to consume tobacco or a tobacco-like substance, and it also treats mere possession of a lit item as smoking for enforcement purposes.

Every violator is also responsible for the costs of prosecution in addition to the fine. Because the ordinance defines the covered area by ownership rather than by distance from a building entrance, an outdoor patio, athletic field, or parking lot on Township land is covered exactly the same as a building would be.
