Clifton, NJ Public Conduct: Outdoor Smoking Restrictions (2026)

Clifton Code Section 381-2 bans smoking outright in every building owned, leased or rented by the City of Clifton, requiring no-smoking signs or the international no-smoking symbol at each building entrance and inside every enclosed area where smoking is prohibited. A. 2C:33-13, 40:48-1, 40:48-2 and 26:3D-63, with signage posted both on the building and around the perimeter. Subsection C, added in 2010, bans smoking in all public parks, playgrounds and ball fields owned or leased by the City, and in any City-owned property where the public gathers for recreation, including adjacent parking areas, driveways and drive aisles, once those areas are marked with no-smoking signs.

The chapter's definition of "smoking" reaches the burning, inhaling or possessing of a lit cigar, cigarette or pipe, or inhaling or exhaling smoke or vapor from an electronic smoking device, so vaping is covered the same as traditional tobacco. Enforcement runs through four departments at once under Section 381-3: Police, Fire, Housing and Health. Section 381-5 bars retaliation against any employee or applicant who exercises the right to a smoke-free workplace or public place, and Section 381-6 tasks the Health Department with ongoing public education on the chapter's requirements.
