Clovis, CA Public Conduct: Outdoor Smoking Restrictions (2026)

01(15) of the Clovis Municipal Code makes it unlawful for any person to "use a tobacco or tobacco related product" or to dispose of one anywhere in a City park except in a designated waste container. The definition sweeps broadly: it covers cigarettes, cigars, little cigars, chewing tobacco, pipe tobacco, and snuff; products derived from any other weed or plant including cannabis that is smoked, heated, chewed, absorbed, dissolved, inhaled, snorted, sniffed, or otherwise ingested (except food products meant for nourishment); and any electronic device that delivers nicotine, cannabis, or other vaporized liquids, including e-cigarettes, e-cigars, e-pipes, or hookahs.

"Use" is defined to include lighting, heating, burning, smoking, chewing, ingesting, snorting, sniffing, inhaling, absorbing, dissolving, and vaping, so the ban reaches far past traditional cigarette smoking. The City is required to post signage "in a quantity and manner reasonably likely to inform individuals occupying a City park" that smoking and tobacco use are prohibited in the area, which puts the public on notice at park entrances and common areas. 3, "Prohibited Acts in City Parks," alongside bans on alcohol possession, gambling, and unlicensed vending, all enforced the same way under the same chapter.

The tobacco subsection was added by Ordinance 97-10 in 1997 and amended twice, by Ordinance 07-26 in 2007 and Ordinance 16-18 effective October 12, 2016, which is when the vaping and e-cigarette language was folded into the definition.
