02(A) bars possessing a can, bottle, or other container of alcohol that has been opened, its seal broken, or its contents partly removed, and bars drinking any alcoholic beverage, in any park, playground, street, sidewalk, alley, or other publicly owned place open to the general public. Subsection (B) applies the identical possession-and-consumption ban to privately owned parks, playgrounds, streets, sidewalks, alleys, and parking lots that are open to the general public, such as a shopping-center lot. Two exceptions run through both subsections: alcohol possessed or consumed on premises licensed under the state Alcoholic Beverage Control Act, and containers held only for recycling.

Subsection (C) separately bars possessing an open container on the premises of an off-sale retail liquor store, including its adjacent parking lot and public sidewalk, and requires every off-sale retailer to post a clearly visible notice of the rule, in wording, size, and placement approved by the Chief of Police; new stores must post before opening, and existing stores had thirty days from the ordinance's effective date to comply. 02 an infraction rather than a misdemeanor, punishable under the Title 1 penalty chapter.
