Colorado Springs, CO Public Conduct: Outdoor Smoking Restrictions (2026)

Article 6, Part 2 begins with a legislative finding that smoking on park property is a fire and litter hazard: City Council cites 'the current and chronic severely dry state and inundation of combustible materials in or on park property' as its reason for the ban (Sec. 201). PARK PROPERTY is defined broadly in Sec. 202 to include 'any real or personal property, or improvements of or relating to City owned or leased parks, open space, trails, and park facilities', so the prohibition follows trails and open space, not just picnic areas.

Sec. 203 states the rule directly: 'it shall be unlawful for any person to smoke, light, or carry any lighted smoking instrument in or on any park property,' unless the area has been designated for smoking under Sec. 205. SMOKING is defined in Sec. 202 as carrying or lighting 'a lighted pipe, lighted cigar, or lighted cigarette of any kind', the park ban targets combustible smoking instruments specifically, tied to the fire-hazard rationale in Sec. 201. Sec. 205 declares all park property and transit facilities 'nonsmoking areas unless an area is designated where smoking is not prohibited,' and any designated area must be 'clearly identified' with disposal receptacles provided.

A parallel rule in Sec. 204 bans smoking, and separately electronic smoking devices and their vapor, inside City transit facilities such as buses and the downtown transit center. This Part 2 ban is separate from the older Part 1 indoor smoking rules for restaurants and workplaces (Secs. 101-111), which only cover enclosed public places.
