East Orange, NJ Public Conduct: Outdoor Smoking Restrictions (2026)

East Orange City Code Chapter 230 prohibits smoking in all municipal buildings, defined to include every structure the City owns, leases, rents or operates for official business. The ban extends outdoors too: smoking is prohibited within a fifty-foot radius of the entrances of all municipal buildings, though the City Administrator, after consulting the Fire Chief and the Director of Public Works, can designate specific smoking areas exempt from that fifty-foot rule, which must be marked with posted 'Designated Smoking Area' signs. Separately, smoking is banned in all public parks and recreational facilities owned or leased by the City, and in any adjacent parking area, driveway or drive aisle, wherever those areas have been posted with no-smoking signs or the international no-smoking symbol.

Smoking is also banned inside any vehicle registered to the City of East Orange. The Police, Fire, Recreation, Public Works and Health Departments all share enforcement authority under § 230-3. A separate rental-housing provision requires landlords entering a residential lease to give tenants a written smoking-policy disclosure on a form from the Department of Health, spelling out whether smoking is prohibited, allowed throughout, or allowed only in limited areas, before the tenant signs a lease or pays a deposit.
